Understanding the Ten Year Rule

Many people may be under the misconception that if you have been married for 10 years in California, one spouse will, or could, be granted permanent alimony in a divorce. Unfortunately for some, and fortunately for others, there is no specific 10 year rule.

Under California law, a marriage of "long duration" allows the court to "retain jurisdiction" indefinitely, unless the parties agree otherwise. This does not mean that any order of alimony imposed will be of indefinite duration. It only means that the court keeps jurisdiction over the case to continue making determinations about matters brought before the court by either of the parties. The law grants the court continued jurisdiction in divorce cases where the marriage was over 10 years of duration.
