Postnuptial Agreements Are on the Rise in California

California is a pioneer among the United States on many social issues, and one example of this is seen in reports about an increase in the number of postnuptial agreements being sought by married couples. Requests for postnuptial agreements have risen over the last three years, according to more than 50 percent of respondents to a recent survey of family law attorneys, released by the American Academy of Matrimonial Lawyers.

postnup is a marital contract that couples enter into after they have become married, to establish how their assets should be divided should their marriage end in divorce. Postnups may include details on children as well as possible spousal disport. A postnup is also suitable for spelling out the details of probate and dividing property following the end of a marriage. Men make up the majority of spouses seeking postnups, the report noted, with 42 percent of attorneys receiving inquiries from husbands and 10 percent seeing inquires coming from wives.
